Tour Sales Contract

FOR LİDYA TRAVEL TOURISM TRAVEL AGENCY INTERNATIONAL PACKAGE TOUR AGREEMENT

This agreement has been prepared within the scope of the Law No. 6502 on the Protection of Consumers and the Regulation on the Procedures and Principles Regarding Package Tour Agreements dated 14.01.2015.
The provisions of the Law and the Regulation shall apply to matters not included in the agreement. Before the agreement was executed, an information brochure was given to the consumer, and after this brochure was read by the consumer, this agreement was drawn up and signed. This agreement aims to determine the rights and obligations of the parties regarding the sale and performance of the service purchased by the consumer from Lidya Ada Turizm ve Tic. Ltd. Şti., the content and sales price of which are specified and whose information is included in the brochure.

1–PARTIES
1.1 –PACKAGE TOUR ORGANIZER

(I accept and declare that all information in the consumer/participant section is accurate as written. In addition, in the agreement below, I will hereinafter be referred to as the Consumer/Participant.)

2- SUBJECT:
The subject of this agreement is the determination of the rights and obligations of the parties within the scope of the package tour service purchased by the Consumer/Participant from LİDYA TOUR.
2.1 –This agreement applies, in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Package Tour Agreements Regulation dated 14.01.2015, to the consumer, whether natural or legal person, acting for non-commercial and non-professional purposes, and to the participant on whose behalf or for whose benefit a package tour is purchased or promised to be purchased or to whom a package tour agreement is transferred.
2.2 –All information regarding the Package Tour (the departure and return date and place of the journey, transportation vehicles used, travel departure and return times, dates and places, type and characteristics of accommodation, meal plan, route, visa, passport, age and health information suitable for the package tour, minimum number of participants required for the tour to be organized and the deadline for cancellation notice, tour price) is included in Annex 2, “Detailed Itinerary,” delivered together with the agreement. The “Tour Participation Form” in Annex 1 shall be filled out completely and accurately by the Consumer/Participant. The Consumer/Participant accepts that he/she is a party on behalf of all participants specified in this agreement and represents and binds them, and that he/she is obliged and responsible for informing all participants of the contents of the “Detailed Itinerary” provided to him/her within the scope of the relevant legal legislation. Consumers/Participants who fail to fulfill their obligation to provide information are responsible for this. Accordingly, the “Detailed Itinerary” provided to the Consumer/Participant is deemed to have been provided to all participants.
The Consumer/Participant accepts and declares that the “Detailed Itinerary” in Annex 2 and the “Tour Participation Form” in Annex 1 fulfill the functions of the “Pre-Information Brochure” pursuant to Article 5 of the Package Tour Agreements Regulation, that this information has been shared with him/her before this agreement, and that they are integral parts of this agreement.
2.3 –LİDYA TOUR is obliged, under this agreement, to provide compulsory travel insurance to all Consumers/Participants who will participate in the trip pursuant to Law No. 1618. This insurance starts with the date and time on the policy and ends with the completion date and time of the tour.
2.4 – The Consumer/Participant is responsible for ensuring that his/her own and the other participants on whose behalf he/she acts’ information is provided correctly and entered into the agreement. LİDYA TOUR shall not be responsible for consequences arising from the incorrect notification of identity and contact information (e.g., airline penalty, visa problem, failure to receive travel-related notifications, inability to participate in the tour, etc.).
2.5 – The Consumer/Participant accepts, declares and undertakes that he/she and all participants can be reached through the contact information specified in this agreement.

3–GENERAL PROVISIONS:
3.1 –Payments and Reservation Conditions:
The full tour fee must be paid to the agency at the time of booking. If the Consumer/Participant requests cancellation of the agreement, the cancellation conditions set forth in this agreement shall apply.
Although tour prices for international package tours are determined in foreign currency, the exchange rate is determined based on the central bank rate on the day the agreement is executed and payment is made.
3.2 – Price changes:
LİDYA TOUR cannot change the price of the sold tour for any reason. However, the price specified in the agreement may be changed up to five percent of the contract price, provided that the reason for the price change and how it will be calculated are notified in writing or through a durable data storage device to the Consumer/Participant at least twenty (20) days before the departure date stipulated in the agreement; in international package tours where the contract price is determined in foreign currency, if the price change is due to extraordinary changes in the exchange rate, in all package tours if the price change is due to extraordinary changes in fuel costs, and if the price change is due to extraordinary changes in taxes, duties, fees and similar legal obligations collected at ports, airports and similar places.
3.3 –Changes to essential elements of the agreement:
Before the package tour begins, LİDYA TOUR shall immediately notify the Consumer/Participant of any material changes made to the content of the agreement for reasons not caused by the Consumer/Participant and the effects thereof on the price. If one of the essential elements of the agreement changes, the Consumer/Participant may either accept this change or, provided that he/she notifies in writing or through a durable data storage device that he/she does not accept the change; choose one of the following options: participate in another package tour of equal or higher value offered by the package tour organizer or intermediary without paying any additional fee, or participate in a lower-value package tour provided that the price difference is refunded to him/her, or withdraw from the agreement without paying any compensation.
If the Consumer/Participant exercises the option to withdraw from the agreement under this article; LİDYA TOUR shall refund all amounts paid by the consumer/participant, without any deduction, within no later than fourteen days from the date on which the notice of withdrawal from the agreement reaches it. The right to make early booking campaigns and offer discounted prices to early bookers belongs to LİDYA TOUR.
3.4 –Cancellation of the package tour:
If LİDYA TOUR cancels the tour before the package tour begins for a reason not arising from the Consumer/Participant, the Consumer/Participant may exercise one of the optional rights specified in Article 3.3 of this agreement.
If the Consumer/Participant wishes to cancel the tour before the package tour begins; there is a free cancellation right up to 30 days before departure. In addition to the deduction rates specified below, LİDYA TOUR shall also refund the remaining fee after deducting the non-refundable expenses made on behalf of the Consumer/Participant.
If cancellation or change is requested 30-15 days before the tour date; the consumer/participant agrees and undertakes to pay 50% of the tour fee as a cancellation fee, and the entire amount if 14 days or less remain. Documents submitted together with the cancellation request by the participant, such as hospital reports obtained from authorities in Turkey, workplace leave documents, etc., are not accepted for the cancellation of hotels and services they will receive outside Turkey.
If there are 30 days or more before the tour starts; the cancellation and change rules of the relevant companies apply exactly to the airline, train and ship tickets and accommodation already purchased. Again, the penalty applied by the relevant companies to the airline, train, ship tickets and accommodation purchased due to cancellations shall be reflected to the Consumer/Participant.
In the event of package tour cancellation by the Consumer/Participant; the package tour organizer or intermediary shall refund to the Consumer/Participant the amount paid, within no later than fourteen days from the date the notice of withdrawal from the agreement reaches them, subject to deductions in accordance with the above conditions.
3.5 –Incomplete performance of the agreement:
The Consumer/Participant is obliged to immediately notify LİDYA TOUR of any deficiency arising during the performance of the agreement (within the framework of the information obligation set out in Article 2.2 of this agreement). If this deficiency is not remedied, the Consumer/Participant has the right to request a reduction in the contract price. When it is determined that LİDYA TOUR has not fulfilled or cannot fulfill a significant obligation after the package tour has started, LİDYA TOUR shall offer equivalent alternative arrangements that do not impose additional costs on the Consumer/Participant for the continuation of the package tour or shall compensate for the difference between the services offered to the Consumer/Participant and those provided.
The Consumer/Participant may withdraw from the agreement by not accepting the alternative arrangement. In the event of withdrawal from the agreement, LİDYA TOUR’s right to demand a fee ceases and any payments made shall be refunded to the Consumer/Participant within no later than fourteen days from the date of withdrawal from the agreement. However, LİDYA TOUR may request appropriate compensation for the services it has already performed, proportionate to the extent to which the Consumer/Participant has benefited from the service. In the event of withdrawal from the agreement, LİDYA TOUR or its intermediary is obliged to provide free transport of the Consumer/Participant to the place where the package tour started or to another agreed place, and to cover the expenses incurred if compulsory accommodation is required.
3.6 – Force Majeure and Other Changes:
Natural disasters (earthquake, flood, fire, landslide, etc.), extraordinary circumstances (martial law, curfews, general strike, terrorism, hotel and airport raids, aircraft hijackings, war, turmoil, etc.), public movements (strike, rally, march, road closure, etc.), interstate tensions, diplomatic restrictions, health problems (epidemic, quarantine, global disease, etc.), adverse weather conditions (snowfall, blizzard, fog, storm, lightning strike, etc.), changes in customs regimes or general restrictions in the transportation sector, or special restrictions such as the bankruptcy or liquidation of any airline, train, sea or road transport company, and any other cause including but not limited to these, directly or indirectly, for any unforeseen adverse situation for which LİDYA TOUR is not at fault, LİDYA TOUR shall not be liable for any damage or loss arising from the consequences of such situations, nor shall LİDYA TOUR be held responsible for its inability to fulfill its obligations or any disruptions in their performance, and no material or moral liability can be imposed on LİDYA TOUR.
Contrary to the agreements made between LİDYA TOUR and the transportation vehicles (airplane, bus, train, ship, helicopter, balloon, 4x4, etc.), LİDYA TOUR cannot be held responsible for the consequences of any adverse situation arising from the delays, breakdowns, accidents of these vehicles, or personal faults of the drivers, and no material or moral liability can be imposed on LİDYA TOUR. LİDYA TOUR is absolutely not responsible for any changes in flight times, cancellation of flights, delays caused by technical problems, or changes made by airlines; the responsible parties are the owners of the relevant transportation vehicles.
LİDYA TOUR acts as an intermediary between the airline and the Consumer/Participant and is subject to the Hague Protocol dated 28/09/1955. Flight times may change before departure and all times must be confirmed 48 hours before the departure dates.
LİDYA TOUR cannot be held responsible for damages arising from non-performance of the agreement during the performance period; if the non-conformity arises from the fault of the Consumer/Participant, if there is an unexpected and unavoidable act of a third party not involved in the performance of the agreement, if there is force majeure, if an event occurs that LİDYA TOUR, its intermediary or independent service provider could not foresee and prevent despite exercising due diligence, if the package tour is canceled due to failure to meet the minimum participation required for its organization and if the cancellation has been notified to the participant in writing or through a durable data storage device twenty (20) days before the start of the package tour within the period stipulated in the agreement. In this case, LİDYA TOUR or its intermediary and their representatives at the location are obliged to provide prompt assistance if the Consumer/Participant is in distress.
LİDYA TOUR reserves its other “force majeure” rights granted to it by other legislation and not added here.
3.7 – Transfer of the agreement:
If the Consumer/Participant cannot continue the package tour, he/she may transfer the agreement to a third party who meets all the conditions applicable to the package tour by notifying the package tour organizer or intermediary in writing or through a durable data storage device at least 60 days before the start of the tour. However, in the transfer process, the cancellation and change rules of the relevant companies shall apply exactly to the airline, train and ship tickets and accommodation already purchased, and if there are penalties, they shall be reflected to the passenger.
The transferor and transferee of the package tour agreement shall be jointly and severally liable to LİDYA TOUR or its intermediary for the payment of the remaining amount and all additional costs arising from such transfer. For international tours, the visa fees of participants whose visa procedures have been completed regarding the transferred tours shall not be refunded. Participants who take over the package tour shall be responsible for their own visa obligations. If they do not have visas, or if visas are not issued by the tour start date despite having applied, LİDYA TOUR shall have no liability. It collects the full tour fee from the transferor and/or transferee. In package tours, the transfer of the agreement may be made according to the change conditions of the airline companies or hotels.
3.8 –Termination/cancellation conditions of the agreement:
The Consumer/Participant may unilaterally terminate the agreement, provided that he/she notifies LİDYA TOUR or its intermediary in writing or through a durable data storage device, no later than 60 days before the departure date of the tour. If less than 60 days remain before the tour starts, the deduction specified in the second paragraph of Article 3.4 of this agreement shall apply to the Consumer/Participant.
In termination notices made before the package tour starts, the amount paid by the Consumer/Participant shall be refunded to him/her, except for mandatory taxes, duties and similar legal obligations and non-refundable amounts paid to third parties and documented.
Again within this scope, the cancellation and change rules of the relevant companies shall apply exactly to the airline, train and ship tickets and accommodation previously purchased, and if there are penalties, they shall be reflected to the passenger. In refunds made through the bank, the bank transfer fee shall be borne by the Consumer/Participant. The Consumer/Participant shall not have any right to compensation for this reason. Refunds shall be made to the Consumer/Participant within fourteen days from the date the termination notice reaches LİDYA TOUR or its intermediary.
When the Consumer/Participant or LİDYA TOUR cancels the trip in accordance with the cancellation conditions period; if the payment was made by credit card, it will be refunded by credit card; if it was made through the bank, it will be refunded through the bank; if it was paid in cash, it will be refunded in cash. The amount to be refunded will be in the currency in which the payment was made to LİDYA TOUR. LİDYA TOUR cannot be held responsible for any exchange rate differences that may occur over time.
For payments made by credit card, the refund will be made to the same credit card of the Consumer/Participant. LİDYA TOUR cannot be held responsible for any damages that may occur. LİDYA TOUR cannot be held responsible for delays in refunds to credit cards; its responsibility ends when it presents the document proving that the refund has been made to the Consumer/Participant.
3.9 –Disclaimer of liability:
Any clauses in the contract text or in any separate document stating that the Consumer/Participant waives the rights granted in the Regulation, or that limit or eliminate the obligations of LİDYA TOUR or its intermediary arising from the regulation, shall be invalid.
3.10 –Competent Authority for Disputes:
T.R. Consumer Courts, Consumer Arbitration Committees, and other organizations authorized by law are competent to resolve all disputes arising from this agreement. Participants may file their complaints and objections with the Consumer Arbitration Committee or Consumer Court at the place where the participant purchased the goods or services or where they reside, within the monetary limits determined annually by the Ministry in December.
3.11- Exclusive Evidence Agreement
In all disputes arising from this agreement signed between the Consumer/Participant and LİDYA TOUR, the parties hereby accept in advance that this agreement and the documents attached thereto, as well as LİDYA TOUR’s information processing “Records and Outputs” and other records and documents, shall constitute exclusive written evidence; that in any objection, defense, or lawsuit against them, they shall not present evidence against LİDYA TOUR’s information processing “Records and Outputs,” and that they accept LİDYA TOUR’s “Records and Outputs” and waive their right to present evidence against them. (This article has the nature of an exclusive evidence agreement as specified in Article 287 of the Code of Civil Procedure, and no other evidence apart from what is stated in this agreement shall be accepted by LİDYA TOUR.
3.12- Notification, Notification Address and Notification of Changes in the Notification Address
For the performance of the matters in this agreement and for making the necessary notifications, the parties’ addresses specified in the agreement have been determined as their legal residences. Notifications made to these addresses shall be deemed to have been made to the parties, and even if the PARTIES are not present there, the notification shall not be returned and Article 21 of the Notification Law shall apply. The PARTIES accept and undertake that if they do not notify the other party in writing of any change of address, notifications made to their previous address shall be valid.

4–IMPORTANT INFORMATION REGARDING THE PACKAGE TOUR
4.1 –All services included in the fee in package tour programs are specified separately. Tours or services outside these are subject to an additional fee. These tours can only be carried out if sufficient participation is achieved, and no compensation and/or refund can be claimed from LİDYA TOUR due to the non-performance of extra tours. Consumers/Participants who do not wish to participate in the extra tour are kept at places deemed appropriate by the guide along the route. They continue the tour after being picked up at the end of the extra tour. Consumers/Participants have joined the tour knowingly and accepting this.
4.2 – Consumers/Participants are responsible for any delays or similar reasons caused by traffic congestion, late arrival at the accommodation or meeting place, or missing the tour due to the transportation vehicles they use to reach the starting point of the trip (airplane, train, ship, bus or private vehicle). They cannot hold LİDYA TOUR responsible for these matters, nor can they claim any rights or demand compensation. If Consumers/Participants do not arrive at the relevant departure point (airport, station, port, bus terminal or meeting point) at the time announced by LİDYA TOUR, in cases of delay or inability to catch up, the ticket cannot be left open, and the travel fee cannot be refunded under any circumstances.
Last-minute flight delays and gate changes related to flights are determined by the airline at the airport and announced to passengers via information boards or announcements at the airport. Such information is provided instantaneously, and since it is impossible for LİDYA TOUR to know in advance, it is the passenger’s own responsibility to be careful and monitor these warnings at the airport.
4.3 – Except for documenting a service that was not provided despite payment, no refund can be made if Consumers/Participants do not wish to use the transportation vehicle allocated for the tour for any reason, do not wish to stay in the hotel, or wish to leave the tour route or hotel due to personal problems or excuses.
4.4 – The Consumer/Participant accepts and declares that he/she will not hold LİDYA TOUR responsible for the consequences of his/her own health problems (including but not limited to blood pressure, heart, asthma, high altitude problems). The Consumer/Participant is responsible for assessing whether the tour he/she registers for is suitable for his/her health condition.
4.5 – All responsibility regarding baggage and its contents belongs to the Consumer/Participant. LİDYA TOUR cannot be held responsible for the loss of cameras, mobile phones, computers, valuable documents, jewelry, or money left in baggage or handbags.
4.6 – Information Regarding Visa:
LİDYA TOUR is neither entitled nor obliged to examine the passports of Consumers/Participants.
The declaration of Consumers/Participants on this matter shall be taken as basis. It is solely the responsibility of participants who do not receive visa tracking service from LİDYA TOUR, who declare that they have a visa and/or a green passport or a passport that does not require a visa, or who purchase a tour to a visa-free country, to check that their passports comply with the visa-passport conditions of the relevant trip. LİDYA TOUR cannot be held responsible for the inability of persons who do not obtain a visa from LİDYA TOUR, who state that they will obtain their own visa, who purchase a tour to a visa-free country, or who think they have a passport that does not require a visa, to participate in the trip due to visa or passport deficiencies, etc., or other reasons arising from their passports and visas. In such case, Consumers/Participants must ensure that if they hold a green passport or will travel to a visa-free country, their passports have at least 6 months of validity from the end date of the trip, are chip-enabled and not older than 10 years in accordance with the new regulation, have no tears, rips, etc. deformations, that the validity dates of their visas cover the travel dates, that their visa residence periods have not expired, and that the number of entries and exits (single entry – double entry – multiple entry) is correct and that they do not misuse their visas.
If the visa is requested to be obtained by LİDYA TOUR, delivery of documents:
If Consumers/Participants joining an international tour with LİDYA TOUR request that LİDYA TOUR undertake the visa tracking process required for going abroad, the procedures and principles regarding the visa service to be provided to participants by the authorized agency working with LİDYA TOUR are set out in this article.
The documents required for the visa application, as well as the visa expenses and the visa service fee, must be delivered completely, as notified by the relevant consulate, by the Consumers/Participants to LİDYA TOUR and, upon LİDYA TOUR’s request, to the agency no later than 30 days before the tour departure date. The delivered passport must have at least 6 months of validity from the end date of the trip, must not be older than 10 years, and must not have any tears, rips, etc. deformations. Entry to and exit from foreign countries is entirely at the discretion of the relevant country. The relevant country’s consulates may refuse to issue a visa for entry to their country even if there is no reason. For this reason, LİDYA TOUR recommends that Consumers/Participants obtain insurance to tolerate this risk. Consumers/Participants were informed of this at the time of signing the agreement. The validity of passports and deformations on passports (tears, rips, etc.) are the responsibility of the individual, and LİDYA TOUR is not responsible for any disruptions or obstacles that may arise during consular or police checks at country entry.
Responsibilities of the parties in the follow-up of visa procedures:
The Consumer/Participant accepts and declares that, if requested by the Consulate, he/she will personally apply to the Consulate with the documents on the day and appointment time given by the Consulate for personal application. Consumers/Participants who do not go to the appointment cannot make any claim against LİDYA TOUR due to non-issuance of a visa, and the full tour fee shall be collected from the Consumer/Participant.
If the Consumer/Participant delivers his/her passport and documents to LİDYA TOUR or the authorized agency, and the delivered documents are deemed insufficient or incomplete by the Consulate; all obligations arising from the failure to submit the missing documents requested by the Consulate within the specified period shall belong to the Consumer/Participant. Visas that cannot be obtained for this reason are not the responsibility of LİDYA TOUR or the authorized agency, expenses incurred cannot be refunded, and the full tour fee shall be collected.
If the Consumers/Participants have delivered all documents on time and the agency has applied on time, but the application is rejected by the Consulate or, again for reasons not arising from either party, the passports are not delivered by the relevant Consulate by the tour start date, or if the validity period of the visa issued is shortened by the Consulate so that it does not cover the tour dates, no liability shall arise for LİDYA TOUR or the agency.
Even though LİDYA TOUR, the authorized agency, and the Consumers/Participants have fulfilled all their responsibilities, if the visa application is rejected by the Consulate, LİDYA TOUR shall be entitled to receive the entire tour fee, visa expense, and service fee.
If, as a result of the Consumers/Participants’ actions contrary to good faith rules (tax debt, military status, travel ban abroad, blacklisting, etc.) or their own fault, negligence, or failure to fulfill their duty of care (missing, torn, deformed passport, etc.), the visa cannot be obtained or departure abroad is prevented, neither LİDYA TOUR nor the authorized agency shall be responsible. Consumers/Participants are obliged to pay the full tour fee.
Even though all visa procedures have been validly completed, no refund will be made to Consumers/Participants who are not allowed to enter the destination country for any reason or who are not allowed to leave Turkey despite having complete visas, and LİDYA TOUR or the authorized agency shall not be responsible for any damages arising from this situation.
LİDYA TOUR or the authorized agency shall not be responsible.
A Consumer/Participant who declares that they have a visa for the countries related to the tour they will join or states that they will personally follow the visa procedures cannot terminate the agreement on the grounds that the visa procedures were not completed; responsibility belongs to the Consumers/Participants, and they are obliged to pay the full tour fee.
LİDYA TOUR or the authorized agency has no power to enforce or guarantee any performance whatsoever over Consulates. Even though LİDYA TOUR or its agency fulfills its obligations, neither LİDYA TOUR nor its authorized agency is responsible for delays at Consulates, as LİDYA TOUR acts as an intermediary institution. Documents returned by the Consulate are delivered to the Consumers/Participants by LİDYA TOUR or the authorized agency. If the Consulate does not issue a visa, LİDYA TOUR shall have no responsibility, and “why the visa could not be obtained” is based on the Consulate’s statement in accordance with international rules. LİDYA TOUR has no opportunity or authority to discuss these matters.

5– PROCESSING OF PERSONAL DATA:
5.1– LİDYA TOUR collects, uses, processes, stores personal data in accordance with the Law on the Protection of Personal Data No. 6698 (“Law”) and other applicable personal data protection legislation, and, depending on the nature of the service offered to Consumers/Participants, transfers such data to third parties for marketing purposes such as informing about requested activities, sales, special offers, discounts, and campaigns related to services located abroad and/or domestically, while ensuring the security of such data.
5.2- LİDYA TOUR undertakes to carry out e-mail, SMS, and catalog sending activities related to announcements, notices, or advertisements to one or all of the communication channels such as e-mail, GSM number, and home address that participants purchasing services from its company share, in accordance with the “Law on the Regulation of Electronic Commerce.” By signing this agreement, Consumers/Participants have accepted the transmissions made by LİDYA TOUR to their own contact information.
5.3– Consumers/Participants have the right not to want such announcements made to their own channels. LİDYA TOUR undertakes that, if Consumers/Participants notify LİDYA TOUR without paying any fee in such cases via the corporate electronic communication address info@lidyatour.com.tr or by any means it requests, it will cease e-mail, SMS, and postal mailings made to them.

6- SIGNATURE AND BINDING EFFECT
I have read, accepted, and approved the final version of this agreement on behalf of myself and the participants whose names are written below. A copy has been delivered to me, together with all its annexes (pre-information brochure, voucher along with the package tour agreement), via the relevant insurance policy in written/durable data storage form. Within the framework of the Law on the Protection of Consumers and the Package Tour Agreements Regulation, I declare and undertake that I have read and become informed about all the services offered within the scope of the package tour I purchased subject to this agreement and their characteristics, the sales price and payment method, and all pre-information regarding performance, and that I have read and understood the content and clauses of the package tour agreement and have been informed thereof. This declaration shall also apply if my reservation procedures were carried out and signed by someone else on my behalf.
