FOR LİDYA TRAVEL TOURISM TRAVEL AGENCY ABROAD PACKAGE TOUR CONTRACT
This contract has been prepared within the scope of the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on the Procedures and Principles Regarding Package Tour Contracts dated 14.01.2015.
The provisions of the Law and Regulation shall apply to matters not included in the contract. Before the contract was drawn up, the consumer was given an advance information brochure, and after this brochure was read by the consumer, this contract was drawn up and signed. This contract aims to determine the rights and obligations of the parties regarding the sale and performance of the service purchased by the consumer from Lidya Ada Tourism and Trade Ltd. Co., the content and sales price of which are specified and whose information is included in the brochure.
1–PARTIES

(I accept and declare that all information in the Consumer/participant section is correct as written. It will hereinafter also be referred to as the Consumer/Participant in the contract.)
2- SUBJECT:
The subject of this contract is the determination of the rights and obligations of the parties within the scope of the package tour service purchased by the Consumer/Participant from LİDYA TOUR.
2.1 –This contract is valid, in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the regulations of the Package Tour Contracts Regulation dated 14.01.2015, for the consumer, whether a natural or legal person acting for non-commercial and non-professional purposes, and for the participant for whom, on whose behalf, or in whose favor a package tour is purchased or promised to be purchased, or to whom a package tour contract is transferred.
2.2 –All information regarding the content of the Package Tour (the starting and ending date and place of the journey, the means of transport used, the departure and return times, dates and places, the type and characteristics of accommodation, meal plan, route, visa suitable for the package tour, passport, age and health information, the minimum number of participants required for the tour to be organized and the deadline for cancellation notice, the tour price) is included in Appendix 2 delivered together with the contract under “Detailed Travel Program.” The “Tour Participation Form” in Appendix 1 is filled out completely and correctly by the Consumer/Participant. The Consumer/Participant accepts that he/she is a party on behalf of all participants specified in this contract and represents and binds them as well, and that he/she is obliged and responsible for providing all participants with information about the contents of the “Detailed Travel Program” provided to him/her within the relevant legal regulations. Consumers/Participants who do not fulfill their obligation to provide information are responsible for this. Accordingly, the “Detailed Travel Program” given to the Consumer/Participant shall be deemed to have been given to all participants.
The Consumer/Participant accepts and declares that the “Detailed Travel Program” in Appendix 2 and the “Tour Participation Form” in Appendix 1 fulfill the functions of an “Information Brochure” pursuant to Article 5 of the Package Tour Contracts Regulation, that this information was shared with him/her before this contract, and that they are also inseparable parts of this contract.
2.3 –LİDYA TOUR is obliged to arrange Mandatory Travel Insurance for all Consumers/Participants who will participate in the trip under this contract pursuant to Law No. 1618. This insurance begins at the date and time on the policy and ends at the date and time of completion of the tour.
2.4 – The Consumer/Participant is responsible for providing correct information about himself/herself and other participants on whose behalf he/she acts and for entering it into the contract. LİDYA TOUR is not responsible for consequences arising from incorrect reporting of identity and contact information (e.g. airline penalty, visa problem, failure to receive travel-related notifications, inability to participate in the tour, etc.).
2.5 – The Consumer/Participant declares and undertakes that he/she and all participants can be reached through the contact information specified in this contract.
3–GENERAL PROVISIONS:
3.1 –Payments and Reservation Conditions:
The full tour fee must be paid to the agency at the time of registration. If the Consumer/Participant requests cancellation of the contract, the cancellation conditions stated in this contract shall apply.
For overseas package tours, although tour prices are determined in foreign currency, the exchange rate is determined based on the Central Bank exchange rate on the day the contract is drawn up and payment is made.
3.2 – Price changes:
LİDYA TOUR cannot change the price of the sold tour for any reason. However, the price stated in the contract may be changed, provided that the reason for the price change and how it will be calculated are notified to the Consumer/Participant in writing or via a durable data storage device at least (20) twenty days before the departure date stipulated in the contract, and only up to five percent of the contract price; in overseas package tours where the contract price is determined in foreign currency, if the price change results from extraordinary changes in exchange rates, in all package tours if the price change results from extraordinary changes in fuel costs, or if the price change results from extraordinary changes in taxes, duties, fees and similar legal obligations collected at ports, airports and similar places.
3.3 –Change in essential terms of the contract:
Before the start of the package tour, LİDYA TOUR shall immediately notify the Consumer/Participant of any material changes made to the contract content for reasons not arising from the Consumer/Participant and their effect on the price. If one of the essential elements of the contract changes, the Consumer/Participant may either accept this change or, provided that he/she notifies in writing or via a durable data storage device that he/she does not accept the change; use one of the optional rights to participate in another package tour of equal or higher value offered by the package tour organizer or intermediary without paying an additional fee, or to participate in a lower-value package tour on condition that the price difference is refunded to him/her, or to withdraw from the contract without paying any compensation.
If the Consumer/Participant exercises the optional right to withdraw from the contract under this article; LİDYA TOUR shall refund all amounts paid by the consumer/participant without any deduction within no later than fourteen days from the date the notice of withdrawal from the contract reaches it. The right of LİDYA TOUR to run early booking campaigns and offer discounted prices to early registrants is reserved.
3.4 –Cancellation of the package tour:
If LİDYA TOUR cancels the tour before the start of the package tour for a reason not arising from the Consumer/Participant, the Consumer/Participant may exercise one of the optional rights specified in article 3.3 of this contract.
If the Consumer/Participant wishes to cancel the tour before the start of the package tour; they have the right to cancel free of charge up to 30 days in advance. In addition to the deduction rates stated below, LİDYA TOUR will also refund the remaining fee after deducting the non-refundable expenses made on behalf of the Consumer/Participant.
If they request cancellation or changes 30-21 days before the tour date; they accept and undertake to pay 35% of the tour fee as a withdrawal fee up to 20-15 days in advance, 50% up to 20-15 days in advance, and the full amount if 14 days or less remain. Documents such as hospital reports, workplace leave documents, etc. obtained from authorities in Turkey and submitted together with the cancellation request are not accepted for cancellation of the hotels and services they will receive outside Turkey.
If there are 30 days or more before the tour starts; the cancellation and change rules of the relevant companies apply exactly to the purchased plane, train, and ship tickets and accommodation. Likewise, any penalties applied by the relevant companies to purchased plane, train, and ship tickets and accommodation due to cancellations are reflected to the Consumer/Participant.
In case of package tour cancellation by the Consumer/Participant; the package tour organizer or intermediary shall refund the amount paid by the Consumer/Participant to the Consumer/Participant within no later than fourteen days from the date the withdrawal notice reaches it, by deducting in accordance with the above conditions.
3.5 –Incomplete performance of the contract:
The Consumer/Participant is obliged to immediately notify LİDYA TOUR of any deficiency arising during the performance of the contract (within the scope of the information obligation set out in article 2.2 of this contract). If this deficiency is not remedied, the Consumer/Participant has the right to request a reduction in the contract price. If it is determined that LİDYA TOUR has not fulfilled or cannot fulfill an important obligation after the package tour has started, LİDYA TOUR shall offer equivalent alternative arrangements that do not create additional cost for the Consumer/Participant to continue the package tour or compensate the difference between the services offered to the Consumer/Participant and the services provided.
The Consumer/Participant may withdraw from the contract without accepting the alternative arrangement. In the event of withdrawal from the contract, LİDYA TOUR’s right to claim a fee ends and the payments made are refunded to the Consumer/Participant within no later than fourteen days from the date of withdrawal from the contract. However, for the performances it has rendered up to that point, LİDYA TOUR may claim reasonable compensation from the Consumer/Participant proportionate to the extent to which the service has been used. In the event of withdrawal from the contract, LİDYA TOUR or its intermediary is obliged to provide free transportation of the Consumer/Participant to the place where the package tour started or to another mutually agreed place and, if accommodation is mandatory, to cover the expenses incurred.
3.6 – Force Majeure and Other Changes:
Natural Disasters (earthquake, flood, fire, landslide, etc.), extraordinary situations (martial law, curfew announcements, general strike, terrorism, hotel, airport raids, aircraft hijackings, war, unrest, etc.), public movements (strike, rally, march, road closure, etc.), interstate tension, diplomatic restrictions, health problems (epidemic, quarantine, disease worldwide, etc...), weather conditions (snowfall, blizzard, fog, storm, lightning strike, etc.), changes in customs regimes or general restrictions in the transportation sector, or special restrictions such as the bankruptcy or liquidation of any airline, train, sea or road transport company, and any other reason including but not limited to these, directly or indirectly, LİDYA TOUR shall not be responsible for any damage or loss arising from any adverse situation for which it is not at fault or could not have foreseen; nor can LİDYA TOUR be held responsible for its inability to fulfill its obligations or for disruptions in the performance of its obligations due to these reasons, and no material or moral liability can be imposed on LİDYA TOUR.
Despite the agreements made between LİDYA TOUR and transportation vehicles (airplane, bus, train, ship, helicopter, balloon, 4x4, etc.), LİDYA TOUR cannot be held responsible for the consequences of adverse situations caused by delays, breakdowns, accidents, or personal faults of drivers, and no material or moral responsibility can be imposed on LİDYA TOUR. LİDYA TOUR is absolutely not responsible for any change that may occur in flight times, cancellation of the flight, delays and postponements caused by technical problems, or changes made by airline companies; the parties concerned are the relevant transport vehicle owners.
LİDYA TOUR acts as an intermediary between the airline and the Consumer/Participant and is subject to the Hague Protocol dated 28/09/1955. Flight times may change before departure and all times must be confirmed 48 hours before departure dates.
During the performance of the contract, LİDYA TOUR cannot be held responsible for damages arising from the non-performance or improper performance of the contract if the non-conformity arises from the fault of the Consumer/Participant, if there is an unexpected and unavoidable behavior of a third party not included in the performance process of the contract, if there is force majeure, if an event that LİDYA TOUR, its intermediary or independent service provider could not foresee and prevent occurs despite exercising all due care, if the package tour is cancelled due to the failure to achieve the minimum participation anticipated for the organization of the package tour and the cancellation is notified to the participant in writing or via a durable data storage device 20 days before the start of the package tour within the period stipulated in the contract. In this case, LİDYA TOUR or its intermediary and their representatives at that location are obliged to provide prompt assistance if the Consumer/Participant falls into a difficult situation.
LİDYA TOUR reserves the rights of other “force majeure” not included here and granted to it under other legislation.
3.7 – Transfer of contract:
If the Consumer/Participant cannot continue the package tour, he/she may transfer the contract to a third party who meets all valid conditions for the package tour, by notifying the package tour organizer or intermediary in writing or via a durable data storage device at least 60 days before the start of the tour. However, in the transfer process, the cancellation and change rules of the relevant companies apply exactly to the purchased plane, train and ship tickets and accommodation; any penalties, if any, are reflected to the passenger.
The transferor and transferee of the package tour contract are jointly and severally liable to LİDYA TOUR or its intermediary for the payment of the remaining amount and all additional costs arising from such transfer. For overseas tours, visa fees for participants whose visa procedures have been completed in relation to the transferred tours are not refunded. The participants who take over the package tour will be responsible for their own visa obligations. If they do not have visas, or if visas are not issued by the tour start date despite their applications, LİDYA TOUR has no liability. It collects the full amount of the tour fee from the transferor and/or transferee. In package tours, contract transfer may be made according to the change conditions of the airline companies or hotels.
3.8 –Termination/cancellation conditions of the contract:
The Consumer/Participant may terminate the contract unilaterally, provided that he/she notifies the termination request to LİDYA TOUR or its intermediary in writing or via a durable data storage device, no later than 60 days before the departure date of the tour. If less than 60 days remain before the tour starts, the deduction specified in the second paragraph of article 3.4 of this contract shall apply to the Consumer/Participant.
In termination notifications made before the package tour starts, the amount paid by the Consumer/Participant shall be refunded to him/her, except for taxes, duties and similar legal obligations that must be paid and expenses arising therefrom, and non-refundable amounts paid to third parties and documented.
Again within this scope, the cancellation and change rules of the relevant companies apply exactly to previously purchased plane, train and ship tickets and accommodation; if there are penalties, they are reflected to the passenger. In refunds to be made through the bank, the bank transfer fee will belong to the Consumer/Participant. The Consumer/Participant shall not have any right to compensation on this basis. Refunds of the amount are made to the Consumer/Participant within fourteen days from the receipt of the termination notice by LİDYA TOUR or its intermediary.
If the Consumer/Participant or LİDYA TOUR cancels the trip in accordance with the cancellation conditions period; if payment was made by credit card, it is refunded by credit card, if paid by bank transfer, by bank transfer, and if paid in cash, in cash. The amount to be refunded will be in the currency in which it was paid to LİDYA TOUR. LİDYA TOUR cannot be held responsible for exchange rate differences that may arise over time.
For payments made by credit card, the refund will be made to the Consumer/Participant’s same credit card. LİDYA TOUR cannot be held responsible for any losses that may arise. LİDYA TOUR cannot be held responsible for delays in refunds made to the credit card; its responsibility ends when it presents the document proving that the refund has been made to the Consumer/Participant’s information.
3.9 –Disclaimer of liability:
Any records in the contract text or in any separate document stating that the Consumer/Participant waives the rights set forth in the Regulation, or limiting or eliminating the obligations of LİDYA TOUR or its intermediary arising from the regulation, are invalid.
3.10 –Competent Authority for Disputes:
Turkish Consumer Courts, Consumer Arbitration Committees, and other institutions authorized by law are competent for the resolution of all disputes arising from this contract. Participants may submit their complaints and objections to the Consumer Problems Arbitration Committee or Consumer Court in the place where the participant purchased the goods or services or where he/she resides, within the monetary limits determined each year by the Ministry in December.
3.11- Exclusive Evidence Agreement
In all disputes arising from this contract signed between the Consumer/Participant and LİDYA TOUR, the contract and the documents attached to it, as well as LİDYA TOUR’s information processing “Records and Outputs” and other records and documents, shall be exclusively written evidence, and in any objection, defense or lawsuit against these, no evidence shall be presented against LİDYA TOUR’s information processing “Records and Outputs”, and the Consumer/Participant accepts LİDYA TOUR’s “Records and Outputs” and waives the right to present evidence against them in advance. (This article is in the nature of an exclusive evidence agreement specified in Article 287 of the Code of Civil Procedure, and no other evidence apart from those specified in this contract shall be accepted by LİDYA TOUR.
3.12- Notification, Notification Address and Notice of Change in Notification Address
For the fulfillment of the matters in this contract and the making of necessary notifications, the addresses specified in the contract by the parties are designated as their legal residences. Notifications made to these addresses shall be deemed to have been made to the parties, and even if the PARTIES are not present there, the notification shall not be returned and Article 21 of the Notification Law shall apply. The PARTIES accept and undertake that if they do not notify the other party in writing of address changes, notifications made to their previous addresses shall be valid.
4–IMPORTANT INFORMATION REGARDING THE PACKAGE TOUR
4.1 –All services included in the fee in package tour programs are specified separately. Tours or services outside these are subject to an extra fee. These tours can only be carried out if sufficient participation is achieved, and no compensation and/or refund can be claimed from LİDYA TOUR due to the non-performance of extra tours. Consumers/Participants who do not wish to participate in the extra tour are kept at places deemed appropriate by the guide along the route. They continue the tour after the extra tour returns. Consumers/Participants have joined the tour knowing and accepting this.
4.2 – Consumers/Participants are responsible for delays or similar reasons caused by traffic congestion when arriving at the starting point of the trip via transportation vehicles (airplane, train, ship, bus or private car), being late to the accommodation or meeting place, or missing the tour; they cannot hold LİDYA TOUR responsible for these matters and cannot assert any claim or demand compensation. In cases where Consumers/Participants are not present at the relevant departure point (airport, station, port, bus station or meeting point) at the time announced by LİDYA TOUR, the ticket cannot be left open, and the travel fee cannot be refunded under any circumstances.
Last-minute flight delays and gate changes are announced to passengers via information boards or announcements at the airport, as they are determined by the airline at the airport. Such information is provided instantaneously, and since it is not possible for LİDYA TOUR to know in advance, it is the passenger’s own responsibility to be careful and follow these warnings at the airport.
4.3 – Except for documenting a service that was paid for but not provided, no refund is possible if Consumers/Participants do not wish to use the transportation vehicle allocated for the tour for any reason, do not wish to stay at the hotel, or wish to leave the tour route or hotel due to personal problems or excuses.
4.4 – The Consumer/Participant accepts and declares that he/she will not hold LİDYA TOUR responsible for the consequences of his/her own health problems (including but not limited to blood pressure, heart, asthma, high altitude problems). The Consumer/Participant is responsible for evaluating whether the tour he/she registers for is suitable for his/her own health conditions.
4.5 – All responsibility regarding baggage and its contents belongs to the Consumers/Participants. LİDYA TOUR cannot be held responsible for the loss of cameras, mobile phones, computers, valuable documents, jewelry, or money left in baggage or handbags.
4.6 – Information Regarding Visa:
LİDYA TOUR has neither the right nor the obligation to examine the passports of Consumers/Participants.
The declarations of the Consumers/Participants in this regard shall be taken as basis. Participants who do not receive visa tracking service from LİDYA TOUR, declare that they have a visa and/or a green passport or have a passport that does not require a visa, or purchase a tour to a country that does not require a visa, are solely responsible for checking whether their passports comply with the visa-passport requirements of the relevant trip. LİDYA TOUR cannot be held responsible for the inability of persons who do not obtain a visa from LİDYA TOUR, who state that they will obtain their own visa, who purchase a tour to a country without a visa, or who think they have a passport that does not require a visa, to participate in the trip due to visa or passport deficiencies, etc., or other reasons arising from their passports and visas. If Consumers/Participants in this situation are holders of a green passport or will travel to a country without a visa; they must ensure that their passports have at least 6 months validity from the end date of the trip, that they are chip-enabled and not older than 10 years in accordance with the new regulation, that they have no damage such as tears or rips, that the validity dates of their visas cover the travel dates, that their visa residence periods have not expired, and that the number of entries and exits (single entry–double entry–multiple entry) is correct and that they have not used their visas incorrectly.
Submission of documents if the visa is to be obtained by LİDYA TOUR:
In the event that Consumers/Participants who will join an overseas tour with LİDYA TOUR request that LİDYA TOUR undertake the necessary visa tracking process for departure abroad, the procedures and principles regarding the visa service to be provided to participants by the authorized agency working with LİDYA TOUR are regulated in this article.
The documents required for the visa application and the visa expenses as well as the visa service fee must be delivered by the Consumers/Participants to LİDYA TOUR and, at LİDYA TOUR’s request, to the agency, complete as specified by the relevant consulate, at the latest 30 days before the tour departure date. The passport delivered must have at least 6 months validity from the end date of the trip, not be older than 10 years, and have no damage such as tears or rips. Entry and exit to foreign countries are entirely at the discretion of the relevant country. The relevant country’s Consulates may refuse to issue a visa for entry into their country even without any reason. Therefore, LİDYA TOUR recommends that Consumers/Participants obtain insurance to tolerate this risk. Consumers/Participants were informed of this at the time of signing the contract. The validity of passports and deformities in passports (tears, rips, etc.) are the responsibility of the individual, and LİDYA TOUR is not responsible for any problems or obstacles that may arise during consular or police checks at the country entry.
Responsibilities of the parties in the follow-up of visa procedures:
The Consumer/Participant accepts and declares that, if the Consulate requests, he/she will personally apply to the Consulate with the documents at the day and appointment time given by the Consulate in order to make a personal application. Consumers/Participants who do not go to the appointment cannot make any claim from LİDYA TOUR due to the visa not being issued, and the full tour fee is collected from the Consumer/Participant.
If the Consumer/Participant delivers his/her passport and documents to LİDYA TOUR or the authorized agency, and the delivered documents are deemed insufficient or incomplete by the Consulate; all obligations arising from the failure to deliver the missing documents requested by the Consulate from the Consumer/Participant within the specified period belong to the Consumer/Participant. Visas that cannot be obtained for this reason are not the responsibility of LİDYA TOUR or the authorized agency, the expenses incurred cannot be refunded, and the full tour fee is collected.
If the Consumers/Participants have delivered all documents on time and the agency has applied on time, but the application is rejected by the Consulate, or if, for reasons not arising from the parties, the passports are not delivered by the relevant Consulate until the day the tour starts, or if the validity period of the visa issued is shorter than the tour dates as determined by the Consulate, LİDYA TOUR or the agency shall not be held responsible.
Despite LİDYA TOUR, the authorized agency and the Consumers/Participants fulfilling all their responsibilities, in the event that the visa application is rejected by the Consulate, LİDYA TOUR shall have the right to receive the full amount of the tour fee, visa expenses and service fee.
If, as a result of actions by Consumers/Participants contrary to the rules of good faith (tax debt, military status, ban on leaving the country, being on a blacklist, etc.) or their own fault, negligence and failure to fulfill their duty of care (missing, torn, deformed, etc. in the passport), the visa cannot be obtained or departure abroad is prevented, LİDYA TOUR or the authorized agency shall have no responsibility. Consumers/Participants are obliged to pay the full amount of the tour fee.
Even though all visa procedures have been carried out validly, no refunds will be made to Consumers/Participants who are not admitted into the destination country for any reason or who are not allowed to exit Turkey despite having complete visas, and for damages arising from this situation
LİDYA TOUR or its authorized agency shall not be responsible.
The Consumer/Participant who declares that he/she has a visa for the countries related to the tour they will attend or states that he/she will personally follow the visa procedures cannot terminate the contract by claiming that the visa procedures have not been completed; responsibility belongs to the Consumers/Participants, and they are obliged to pay the full amount of the tour fee.
LİDYA TOUR or its authorized agency has no power of sanction over the Consulates and no authority to guarantee their undertakings in any way. Despite LİDYA TOUR or its agency fulfilling their obligations, neither LİDYA TOUR nor its authorized agency is responsible for delays at the Consulates, since LİDYA TOUR is an intermediary institution. Documents returned by the Consulate are delivered to the Consumers/Participants by LİDYA TOUR or the authorized agency. If the Consulate does not issue a visa, LİDYA TOUR has no responsibility whatsoever, and the reason why the visa could not be obtained is based on the Consulate’s statement in accordance with international rules. LİDYA TOUR has no possibility or authority to dispute these matters.
5– PROCESSING OF PERSONAL DATA:
5.1– LİDYA TOUR collects, uses, processes, stores personal data in accordance with the provisions of Law No. 6698 on the Protection of Personal Data (“Law”) and other applicable personal data protection legislation, and, depending on the nature of the service provided to Consumers/Participants, transfers it to third parties for marketing purposes such as informing about activities, sales, special offers, discounts and campaigns related to the requested service located abroad and/or domestically, and ensures the security of this data.
5.2- LİDYA TOUR undertakes to carry out email, SMS sending, and catalog sending for announcement, publication or advertising work to one or all of the communication channels such as email, GSM number, home address, which participants and/or participants who purchase services from its company share, in accordance with the “Law on the Regulation of Electronic Commerce.” By signing this contract, Consumers/Participants have accepted the transmissions that LİDYA TOUR will make to its own contact information.
5.3– Consumers/Participants have the right not to want these announcements made to their own channels. LİDYA TOUR undertakes that in such cases, if Consumers/Participants notify LİDYA TOUR without paying any fee to LİDYA TOUR’s corporate electronic communication address info@lidyatour.com.tr or by any method it requests, it will terminate the email, SMS sending and mailings made to them.
6- SIGNATURE AND BINDING EFFECT
I have read the final version of this contract and accepted and approved it on behalf of myself and the participants whose names are written below. One copy, together with all its appendices (advance information brochure, voucher together with the package tour contract), has been delivered to me in writing / via durable data storage, along with the relevant insurance policy.
